anytime you use someone else's song, you have to pay for it, especially if you distribute it in some way that you make money... of course, if you watch anything on youtube, you'll see that this is not always the case, as there's a billion things on there and in fan films, etc. wherein someone else's music is used. the best first best is always to try to contact the band in some way. if that does not work, you go the licensing route. I know if someone contacted me and said they wanted to use my tunes in their film, I'd probably give them permission, rather than make them license it from someone... but then again, i'm not making any money off my work right now anyway...
