Whether it is released material or not, the fact that it is not
your material but was created by someone else means that, in principle, if you don't have permission to use it, you could be infringing their intellectual property rights.
I don't do IP law, and I can't pretend to have any real knowledge in that area, so I can't give you formal advice.
However, I found

The other thing you could do is to email the band's manager, Mike - you can find the addy on the UWLive site I think - and see if he will be able to give you an answer.
