Tedious Copyright Question

At the minute, im trying to film a student dissertation film which hopefully will be done and dusted in a few days. However, afterwards i need to work on the soundtrack to it, and one of the songs that would be very fitting for it would be the unreleased song Dinner At Rods's from the Peel broadcast. Now, becuase we want to use it, we have to go through the entire artist clearance thing which is understandable, but where do i stand with wanting to use unreleased artist material? The closest thing it is to being on record is the start of the live Japan CD before JAL to Tokoyo kicks in. We do plan to send it off to people for various distribution when done, so we couldnt steal it without permission!

Answers on a postcard please!

Whether it is released material or not, the fact that it is not your material but was created by someone else means that, in principle, if you don't have permission to use it, you could be infringing their intellectual property rights.

I don't do IP law, and I can't pretend to have any real knowledge in that area, so I can't give you formal advice.

However, I found this thread (http://forums.studentfilms.com/eve/forums/a/tpc/f/5486066451/m/8641009914) on the net that addresses the exact same issue. Don't know whether it will be of any use to you, mate.

The other thing you could do is to email the band's manager, Mike - you can find the addy on the UWLive site I think - and see if he will be able to give you an answer.

To license Dinner at Rods you need to go to www.warnerchappell.co.uk

There you can register and request a license for a student film. Then you just submit all your info (which is pretty specific stuff).

So register, then search for songwriter Karl Hyde. Dinner at Rods is on page 4 of the song list. Click on that and then click on license request.

Searching for the song title Dinner at Rods will give you nothing.

Man, so much unreleased material. I wonder how many of them are just little ditties, and how many of them are unheard gems of Darc or All These Things caliber.

I think Chappell's just offer a "one-stop" licencing service for songs - if you search the site you can find references to all UW material on there.

anytime you use someone else's song, you have to pay for it, especially if you distribute it in some way that you make money... of course, if you watch anything on youtube, you'll see that this is not always the case, as there's a billion things on there and in fan films, etc. wherein someone else's music is used. the best first best is always to try to contact the band in some way. if that does not work, you go the licensing route. I know if someone contacted me and said they wanted to use my tunes in their film, I'd probably give them permission, rather than make them license it from someone... but then again, i'm not making any money off my work right now anyway...

Helps been a massive step in looking in this issue, but i think its gonna cost us to much money to do so. Not the end of the world like, we got a muscian oding stuff for us, but that specific piece was lovely.

There is a massive amount of unreleased stuff after looking at the Warner Chappell site! If im bored later, i may make a list for another thread.
